Important Terms

A. USE OF THE PLANS

  1. These Plans are the property of Microspot Ltd. and any associated named architect or designer. These Plans are protected by Federal and International Copyright Laws. Any use of the information contained herein beyond the use authorized by a purchase of Prints or digital, or any duplication, publication, sale or distribution of any part of these Plans without the prior written consent of Microspot Ltd. represents a violation of Federal and International Laws subject to the prescribed penalties.
  2. Purchase and downloading of any PDF plan package grants the purchaser as “Licensee” the right to use such documents to construct a building as per the terms of the Single or Unlimited Build License purchased. A single purchase of the plans allows duplication of prints solely for that purpose. Purchaser acknowledges that all rights of ownership, title, and interest in the copyrights, plans and derivatives remain with Microspot Ltd. Modified plans are considered derivatives of the original and receive the same copyright protection even if completely redrawn. License for use of the Plans ends with the completion of the house (occupancy). Plans are not transferable to a third party. This means if the house is not built the Plans may not be sold to somebody else.
  3. Any use of the Plans, or modifications of the Plans, by purchasers, builders or others is done at their own risk. Licensee shall have the Plans reviewed by a local professional architect or engineer before the start of construction. The information contained within the plans is to indicate design intent and basic construction detailing. It is the builder’s responsibility to provide standard construction details and practices which will result in a structurally sound and weatherproof finished product. Microspot Ltd. and it‘s partners take no responsibility for the accuracy or content of the plans and therefore cannot be held liable to any dmagaes, losses or issues arising from the use of these plans.

B. CONTENT OF THE PLANS

  1. These Plans do not include any detailed electrical, plumbing, heating or air conditioning drawings due to the wide variety of local codes and climatic conditions. Licensee should have a local electrical engineer, mechanical engineer or builder provide detailed electrical, plumbing, heating or air conditioning drawings as may be required for permits and construction. The foundation plan and associated details are provided as a basic guide for a typical spread footing/poured concrete foundation system. The designs as shown are typical for particular regions and may not be acceptable for other locations. Licensee should have a local architect or licensed engineer review these Plans and provide a site-specific foundation design if found necessary.
  2. These Plans provide ideas and concepts and are not intended to be complete in all respects and details. Variations in standard sizes of window and door brands and types and use of different materials and thicknesses can change details. Varying local codes, ordinances, regulations, foundation requirements, and the layout of electrical, mechanical, and plumbing systems can also change details.
  3. No cutting or damage to building structural components will be allowed without written authorization from a local structural engineer.
  4. All utilities shall be connected to provide gas, electric, and water to all equipment whether said equipment is in Contract or not. Equipment shall be guaranteed to function properly upon completion.
  5. Manufacturer’s standard specifications and materials approved for project use are hereby made part of these Notes with same force and effect as if written out in full herein. All appliances, fixtures, equipment, hardware, etc. shall be installed in accordance with Manufacturer’s specifications and procedures.
  6. Written words take precedence over drawn lines. Large-scale details and plans take precedence over smaller details and plans. Should a conflict arrive between the Specifications and Drawings, the requirements deemed most stringent shall be used.
  7. Minor details not usually shown or specified but necessary for proper and acceptable construction, installation, or operation of any part of the Work shall be included in the Work as if it were specified or indicated on the Drawings.
  8. All architectural drawings and construction notes are complimentary. What is indicated and called for by one shall be binding as though called for by all.

C. BUILDER‘S RESPONSIBILITY

  1. It is the responsibility of the builder to assure that all work is in accordance with the latest edition of all applicable National, State, and Local Building Codes. It is the builder’s responsibility to assure that all work is in accordance with the latest edition of all applicable Construction Standards, fire department standards, utility company standards and best practices.
  2. It is the responsibility of the builder to assure that all manufactured articles, material, and equipment are applied, installed, connected, erected, used, cleaned, adjusted, operated and conditioned as directed by the manufacturers. Builder shall follow all instructions to sustain and preserve all expressed or implied warranties and guarantees.
  3. It is the responsibility of the builder to assure that all materials, equipment and components are new and of good quality.
  4. It is the responsibility of the builder to check all dimensions and details for overall accuracy appropriate to the local conditions and the final selection of materials such as masonry, floor joists, lumber, structural members, construction panels, roofing, etc., all of which can create variations in dimensions and details. For example, if standard lumber joists are used in place of engineered floor joists the floor-to-floor dimensions would vary from the Plans and require revised stair dimensions and framing.
  5. It is the responsibility of the builder to arrange for all tests and inspections as specified or otherwise required by the local building department and shall pay all costs and fees for same. The builder shall secure all building permits and upon completion of the project (prior to final payment) deliver to the Owner a Certificate of Occupancy, Use (or equivalent as local conditions require) from the building department.
  6. It is the responsibility of the builder to use licensed contractors/subcontractors for all plumbing and electrical work. Contractors/subcontractors shall submit all required permits, certificates and sign-offs to the Owner for their records prior to final payment.
  7. The General Contractor shall verify all dimensions, be familiar with the existing conditions, and bring any discrepancies to the attention of the Architect before submission of the construction proposal and before beginning work. Drawings may be scaled for estimating purposes and for general reference only. For all other dimensions or locations consult the Architect or refer to dimensions on Drawings. Verify all dimensions in the field.
  8. The General Contractor shall lay out all work and be responsible for all dimensions and conditions for trades such as electrical, plumbing, etc.
  9. All Work shall be guaranteed for a minimum of one year after final approval unless local laws require a longer warranty period. The General Contractor shall sign the written guarantee as provided by the Owner. The guarantee shall cover all general and subcontractor work. All defects discovered during this period shall be repaired to the Owner’s satisfaction at the Contractor’s expense.

D. DISCLAIMER

  1. Names of materials and manufacturers shown on these Plans do not represent an endorsement or recommendation by Microspot Ltd. Final selections of materials are the responsibility of the homeowner and/or builder, including, but not limited to proper installation of materials, nailing, glueing, caulking, insulating, flashing, roofing, weatherproofing and many other small items and details not necessarily indicated on the Plans, and over which Microspot Ltd. has no control or responsibility. Microspot Ltd. shall not be held liable for any errors, omissions, or deficiencies in any form by any party whatsoever.
  2. In no event shall Microspot, or any entity under its control, be held liable for any part of this design as modified by you or your Agent. You are fully responsible for adapting the original design to the requirements of your building site and any applicable local codes and/or regulations. Failure to comply with any term or condition of this license agreement will automatically terminate your license and will make available to Microspot other legal remedies.
  3. This license agreement between Microspot and you, the end user, and supersedes any other communications or advertising with respect to this design and related documentation. If any provision of this license agreement is held to be invalid, the remainder of this agreement shall continue in full force and effect.

E. WHAT‘S INCLUDED IN YOUR PLANS

  1. Exterior Elevations: Show the front, rear and sides of the house, including exterior materials, details and measurements.
  2. Foundation Plans: Include drawings for a standard full basement. All necessary notations and dimensions are included. (Foundation options will vary for each plan. If the home you want does not have the type of foundation you desire, contact Beyond Basics to discuss your options.)
  3. Electrical Layouts: Electrical plans should be designed based on your needs with your electrician. Builders will normally allow an allowance for this work included in their estimate.
  4. Detailed House Floor Plans: Show the placement of interior walls and the dimensions for rooms, doors, windows, stairways, etc., of each level of the house.
  5. Plumbing & Heating: Due to regional variations, local availability of materials, local codes, methods of installation, and individual preferences, it is impossible to include detail on heating and plumbing work on your plans. The duct work, venting, and other details will vary depending on the type of heating and cooling system (forced air, hot water, electric, solar) and the type of energy (gas, oil, electricity, solar) that you use. These details and specifications are easily obtained from your builder, contractor, and/or local suppliers.

  1. Purchaser agrees to comply with all local codes and building regulations. The house plans featured on Microspot web site comply with national recognized building codes in effect at the time they were drawn. Because local and state building regulations vary from region to region and are constantly changing, absolute conformance to purchaser's specific requirements is impossible. Therefore, Microspot authorizes the sale and uses of these plans expressly conditioned upon the purchaser's obligation and agreement to strictly comply with all applicable codes, ordinances, regulations and requirements. Note that certain states require the services and seal of an architect or engineer registered in that state.
  2. Purchaser agrees to check and verify all dimensions and materials before construction. Due to regional variations, Microspot cannot and does not guarantee the availability of any materials or products suggested or specified on plans. Any discrepancies or questions must be reported to Microspot prior to the start of construction.
  3. Prices and conditions are subject to change without notice. All construction plans ordered through Microspot are provided as-is and Microspot disclaims all other warranties, express or implied, including merchantability or fitness of purpose. Microspot is not liable for incidental, special, consequential, or indirect damages of any kind, including, but not limited to, loss of anticipated profits, business opportunity, or other economic loss arising out of the use of services or any construction plans received from Microspot even if Microspot has been advised of the possibility of such damage.
  4. It is the customer's responsibility to ensure the accuracy, compliance with applicable statute or regulation, and fitness of purpose of any plans or construction information received from Microspot prior to use thereof. In the event any liability is imposed on Microspot, Microspot liability to you or any third party shall not exceed the price paid for Microspot product.
